Weekly D945a (Fla. 2d DCA April 26, 2013): where defendant seeks immunity from prosecution (in this case, for the justifiable use of force against a LEO), the proper procedure is to move to dismiss by asserting immunity under Rule 3.190(b). That is the first step; if the State does not grant immunity and continues the prosecution, then the court can enter a dismissal. See Horn v. State, 17 So. 3d 836, 839 (Fla. 2d DCA 2009).
