Rule 3.580. Court May Grant New Trial

wordpress-feat-img-jcbWhen a verdict has been rendered against the defendant or the defendant has been found guilty by the court, the court on motion of the defendant, or on its own motion, may grant a new trial or arrest judgment.

COMMENTARY:  I have used this rule over the years not necessarily to get a new trial from the trial judge, but from the appellate court.  Very important that the trial lawyer use the post-trial rules!
